Summer Workshops Participant Terms & Conditions

Welcome to the Community of Writers. Our community is known for its camaraderie and warmth, and there are a few things that must be understood by those who are taking part.

Any participant or visitor to the Community of Writers (“CW”) summer workshops automatically agrees to the Terms and Conditions set forth below (the “Terms and Conditions”) when submitting the Registration Form. These Terms and Conditions apply to each person (the “Participant”).

PARTICIPANT TERMS & CONDITIONS

 CODE OF CONDUCT

Respect and consideration for others, both within and outside workshop sessions, are core values to be upheld by all participants and teaching staff. CW will not tolerate any instances of discrimination, harassment, or any other form of mistreatment in conjunction with any of our programs. Harassment or disrespect of community members on the basis of race, color, religion, sex, sexual orientation, national origin, age, marital status or ability is unacceptable and will not be tolerated. Participants are expected to adhere to all federal, state and local laws and regulations while participating in a CW program. Should a staff member, contractor, volunteer or program participant be found to violate any aspect of the organization’s code of conduct, the CW reserves the right to dismiss that person from the program. Consequences may include, but not be limited to, suspension, dismissal from the current program or activity, and/or ineligibility for all future activities.

COVID-19 LIABILITY WAIVER

Participant acknowledges the contagious nature of the Coronavirus/COVID-19, and that CW has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. Participant further acknowledges that CW cannot guarantee that participant will not become infected with the Coronavirus/Covid-19. Participant understands that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of themselves and others, including, but not limited to, staff and participants and their families. Participant further avows that any costs arising from a Coronavirus/Covid-19 infection, whether of the participant or of any others in the conference, will be the responsibility of the participant and not CW.

INDEMNITY

Participant acknowledges that they  have agreed to participate in a creative writing workshop (the “Workshop”), sponsored by the Community of Writers, a nonprofit corporation (the “Community”). This Indemnity is in consideration for being permitted by the Community to participate in the Workshop and to use the Community’s facilities.

To the extent permitted by law, the Participant agrees to protect, indemnify, defend, and hold harmless CW, the venue where Conference is being held, as well as the Hotel(s), resort(s), and owners of the private condos / houses where the participant may be residing during the week, and their respective employees, officers, directors, and agents against all claims, losses, or damages to persons or property, governmental charges or fines, and costs (including reasonable attorney’s fees) arising out of or connected to the actions or failure to act in accordance with the Terms and Conditions by the Attendee, its employees, officers, directors, or agents, except those claims arising out of the other party’s gross negligence or willful misconduct.

ACCESSIBLE SERVICES

CW is committed to making all reasonable arrangements that will allow participants the ability to participate in on-site Conference events. All meeting rooms at the conference are wheelchair accessible and have seats in the first row marked as reserved for individuals with accessibility needs, as needed. Attendees who require onsite assistance during the Conference should request it from CW personnel in advance of the workshop.

DIGITAL & OTHER RECORDINGS

Participant gives consent and permission to the Community of Writers (CW) for the use of their likeness, name and voice for use in the manner that CW, its employees or authorized agents may see fit. Participant hereby agrees that all audio and video recordings of their likeness, name and voice produced by CW, its contractors, agents, or employees, may be published, reproduced, exhibited, broadcast, through any media, and used by CW to promote CW without further consent from or payment to the undersigned who hereby forever releases and discharges CW, its employees, licensees, agents, successors and assigns from any claim, actions, damages, demands whatsoever by any such use.

However, if requested, CW, may choose to remove a photograph or video from circulation if request is reasonable.

CANCELLATION POLICY

FORCE MAJEURE

Attendance at the Conference is subject to government authority, disaster, or other emergencies, any of which make it illegal or impossible for CW, the Conference hotel(s), or Venue to provide the facilities and/or services for the Conference, or make it illegal or impossible for the Attendee to utilize the hotels or convention centers for the Conference. A registration may be canceled for any one or more of such reasons by written notice from CW to the Attendee without liability on the part of CW. In the event that the Conference cannot be held or is postponed due to events beyond the control of CW, CW shall not be liable to the Attendee for any damages, costs, or losses incurred, such as transportation costs or financial losses. However, all fees paid to CW will be refunded.
